Brexit and EU Union Custom status of commercial yachts – SOS Yachting requires proof for UK/IOM flagged yachts.

The Union status of a yacht will be kept if a yacht was located within the EU territorial waters on midnight of December 31st, 2020.

If the yacht was out of the EU on/after January 1, 2021 is brought back to the EU and fulfills the conditions to be considered under the ‘Returned Goods Relief’, then it can be declared to Customs as such and preserve its VAT status or import the yacht (still not confirmed in Spain).

SOS Yachting requires the following proof to UK/IOM flagged yachts:

•             Declaration of the EU harbor confirming the yacht was berthed there on December 31st 2020 at midnight;

•             Copy of the logbook (stamped and signed by the captain) confirming the yacht was berthed there on December 31st 2020 at midnight;

•             Copy of the invoice or contract with the EU harbour confirming the yacht was berthed there on December 31st 2020 midnight

•             AIS/GPS extract and photos confirming the yacht was within the EU Union territory (berthed in the harbor) on December 31st 2020.
