Cruising restrictions and Owner's use June 2016

Are there any other restrictions if a charter arrives in Spain from another country? 
If the charter starts outside Spain and guests embark/disembark or the charter ends in Spain, the yacht must have a charter license. However, if the yacht starts the charter outside Spain and no guests embark/disembark in Spanish waters, and the charter does not end in Spain, no license is necessary. 
Does the Beneficial Owner have to pay VAT on its/his charter?
Yes, the Beneficial Owner can use the yacht with a charter contract in place and pay VAT on the charter fee. However, if the Beneficial Owner is Spanish or has an economic connection with Spain, the advisability of chartering in Spain must be assessed case by case since VAT might become due on the value of the hull.
